1. Acceptance of these Terms

By downloading, accessing, or using Ask Seek Grow, you agree to these Terms of Use. If you do not agree, do not use the app.

Ask Seek Grow is provided by Desert Toad Software LLC. These Terms supplement any applicable terms provided through Apple, including Apple's applicable license terms or Standard Licensed Application End User License Agreement if that EULA applies to your copy of the app. If these Terms conflict with mandatory Apple terms, the applicable Apple terms control to the extent required.

2. Description of the service

Ask Seek Grow is an iPhone application for Christian faith and spiritual growth. It includes Bible reading and search, prayer and reflection tools, the Gratitude Journal, Acts of Service Journal, Reflection Journal, questions, faith-centered habit tools, reminders, optional membership features, and eligible manual iCloud/CloudKit sync.

3. Eligibility

You must be legally permitted to use the app and to enter into these Terms. If you use the app on behalf of a minor or allow a minor in your care to use it, you are responsible for determining whether the app is appropriate for that person and for supervising that use as appropriate.

4. Apple and App Store terms

Your download, purchase, subscription, use, and device access may also be subject to Apple's App Store rules, Apple Media Services terms, applicable license terms, and other Apple policies. Apple is responsible for its own services, including the App Store, StoreKit, iCloud, CloudKit, and iOS platform services.

5. Free and membership functionality

Core functionality is available without membership. Free use currently includes prayer reminders, habit reminders, up to 4 current prayers, up to 4 current habits, up to 4 open questions, up to 1 Gratitude Journal entry per calendar day, up to 1 Acts of Service Journal entry per calendar day, and up to 1 Reflection Journal entry per calendar day.

Membership currently adds unlimited prayers, unlimited habits, unlimited open questions, unlimited Gratitude Journal entries per day, unlimited Acts of Service Journal entries per day, Bible Notes, Bible Bookmarks, habit metrics and insights, restoration of archived prayers and habits, saving Daily Verse images, manual cloud sync, and future premium features that may be added over time.

The Gratitude Journal and Acts of Service Journal remain available without membership; membership removes their daily entry limits. The Reflection Journal remains limited to 1 entry per calendar day for both free users and members. Features may evolve in future app versions. A feature described as planned or future is not guaranteed unless and until it is actually released.

6. Membership billing and automatic renewal

Membership purchases and subscriptions are processed through Apple's App Store and StoreKit. The price, billing period, trial terms if any, and other purchase details are shown by Apple at the time of purchase.

If a membership is offered as an automatically renewing subscription, it renews according to the terms presented by Apple unless you cancel it through your Apple account before renewal. Desert Toad Software LLC does not receive your full payment-card details.

7. Cancellation, refunds, and restore purchases

You can manage or cancel an App Store subscription using the subscription-management options provided by Apple. Refund requests for App Store purchases are handled under Apple's refund processes and policies; Desert Toad Software LLC does not control Apple's refund decisions.

Where supported, the app may provide a Restore Purchases function that uses Apple services to restore eligible purchases associated with your Apple account.

8. Your content and data

You remain responsible for the prayers, Gratitude Journal entries, Acts of Service Journal entries, Reflection Journal entries, questions, notes, habits, and other content you enter into the app. You should not enter content that you do not have the right to use or that violates applicable law.

Most user-created app data is stored locally on your device unless you choose an eligible manual cloud-sync feature. Our handling of information is described in the Privacy Policy.

9. Manual iCloud / CloudKit sync

Version 1 manual cloud sync is user-initiated. You choose when to sync eligible data by tapping Sync Now. Manual cloud sync is a membership feature. Eligible synced data includes Acts of Service Journal entries along with other data supported by the app's current sync implementation.

Sync depends on Apple services, your Apple account, network availability, device configuration, and the data available on the participating devices. We do not guarantee uninterrupted synchronization, conflict-free synchronization, or that cloud services will always be available.

Habit reminder and alarm settings remain local to each device and are not included in cloud sync.

10. Reminders and notifications

Reminder behavior depends on iOS permissions, device settings, system conditions, and the configuration you choose. You are responsible for reviewing and maintaining reminder settings on each device. Reminders are convenience features and should not be relied on for emergencies or safety-critical purposes.

11. Bible and faith-related content

Ask Seek Grow is intended to support personal Scripture reading, prayer, reflection, and faith-centered habits. It does not claim to provide authoritative theological, pastoral, denominational, or spiritual direction for every user or tradition. Bible translations included in the app are identified within the product and may be subject to their own source or attribution notices.

12. No professional advice

Ask Seek Grow is not a medical, mental-health, legal, financial, emergency, or other professional service. Content and tools in the app are not a substitute for advice from a qualified professional, emergency service, clergy member, counselor, or other appropriate person when such assistance is needed.

13. Appropriate use

You agree not to misuse the app, interfere with its operation, use it unlawfully, attempt unauthorized access to systems or services, or use the app in a way that infringes the rights of others. Additional restrictions may apply under Apple's applicable license terms.

14. Intellectual property

Ask Seek Grow, its software, design, branding, and original product materials are owned by Desert Toad Software LLC or used with permission, except for Bible text, Apple technologies, third-party materials, or other content that belongs to its respective owners. Nothing in these Terms transfers ownership of Desert Toad Software intellectual property to you.

15. Third-party services and links

The app relies on certain Apple platform services and may link to third-party websites. We do not control third-party services, and their availability, terms, privacy practices, and content are their responsibility.

16. Changes to the app or service

We may add, modify, suspend, or discontinue app features as the product evolves, subject to applicable law and App Store requirements. We do not promise that planned features will be released on a particular date or at all.

17. Disclaimer of warranties

To the maximum extent permitted by applicable law, Ask Seek Grow is provided on an “as is” and “as available” basis without warranties of uninterrupted operation, error-free performance, continuous synchronization, or permanent data availability. Some jurisdictions do not allow certain warranty disclaimers, so some of these limitations may not apply to you.

18. Limitation of liability

To the maximum extent permitted by applicable law, Desert Toad Software LLC will not be liable for indirect, incidental, special, consequential, or punitive damages arising from or related to use of the app, loss of data, missed reminders, unavailable cloud services, or inability to use the app. Nothing in these Terms excludes liability that cannot legally be excluded or limited.

19. Termination

You may stop using the app at any time. We may suspend or terminate access to features we control if reasonably necessary to address unlawful use, abuse, security issues, or violations of these Terms, subject to applicable law and Apple platform requirements.

20. Changes to these Terms

We may update these Terms when the app, business, legal requirements, or services change. The effective or last-updated date at the top of this page will be revised when the Terms change materially. Continued use after an updated version becomes effective constitutes acceptance to the extent permitted by law.

21. Governing law

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict-of-laws principles, except where applicable law requires otherwise.

22. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect to the extent permitted by law.
